Terms and Conditions
1. Service Agreement
By engaging Atlantico Websites' services, you enter into a legally binding agreement for web design services. This agreement remains in effect until canceled by either party with a 30-day written notice.
2. Payment Terms
• Monthly Payments: Payments are due monthly and will be automatically charged to the payment method on file. You are responsible for ensuring that your payment method is current and valid.
• Late or Failed Payments: If a payment fails, you have a 15-day grace period to resolve the issue. After this period, Atlantico Websites reserves the right to suspend services and take your website offline until payment is successfully processed.
• Grace Period & Service Suspension: If payment is not received within the 15-day grace period, your website will be deactivated. Service reinstatement will occur only after all outstanding payments, including any applicable late fees, are settled.
• Late Fees: A late fee of 1.5% of the outstanding balance (or the maximum allowed under Virginia law) may be applied after 15 days of non-payment.
3. Website Ownership and Usage Rights
Clients are not permitted to migrate, copy, download, or save the website—in whole or part—at any point during or after the contract. Atlantico Websites retains full ownership and control over the website.
4. Cancellations
This agreement remains active until canceled by either party. To cancel your service, you must provide a 30-day written notice via email or through our designated customer support channels.
Essential & Standard Plans
You may cancel your subscription at any time if you are subscribed to our Essential and Standard plans; however, your website is not transferable.
Custom Plan
When you sign up for our Custom plan, you agree to a 12-month commitment and are responsible for any remaining balance. After the 12 months or once your commitment is complete, we will help you export your website so you can host it wherever you choose.
5. Disruption of Services
If payment is not received within the 15-day grace period, Atlantico Websites reserves the right to suspend your website. The website will remain offline until full payment is made. Atlantico Websites is not liable for any losses incurred during the period of suspension.
6. Dispute Resolution
In the event of a dispute, both parties agree to first attempt resolution through good faith negotiation. If negotiations fail, the Chesterfield County courts shall have exclusive jurisdiction over any legal action.
7. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Commonwealth of Virginia, specifically those applicable in Chesterfield County. Any disputes shall be resolved in the courts of Chesterfield County, VA.
8. Consumer Protection
Atlantico Websites complies with all applicable consumer protection laws in the Commonwealth of Virginia, including those governing online and electronic transactions.
9. Amendments and Modifications
Atlantico Websites reserves the right to update these terms at any time, with changes taking effect upon written notice to the client. Any material changes will be communicated in advance, providing you an opportunity to review and agree to the modifications.
10. Electronic Signatures and Acceptance
By engaging with Atlantico Websites and paying for services, you consent to the use of electronic records and signatures, which are valid under Virginia’s Uniform Electronic Transactions Act (UETA). This agreement becomes legally binding upon your acceptance of services.
11. Intellectual Property
All designs, code, and content developed by Atlantico Websites remain the intellectual property of Atlantico Websites unless otherwise agreed upon in writing. Unauthorized use or reproduction of this material is strictly prohibited.
12. Free .com domain
The promotional .com domain included in our plans is serviced through Squarespace and it is based on the price of an unclaimmed, non-premium domain. If the domain you desire for your business exceeds the promotional cost amount and there is no other alternative, you will be responsible for the initial purchase and renewal of that premium domain. Atlantico Websites reserves the right to reject any customer's request for the purchase of any premium, illicit, or vulgar .com domain.
